New Courts to Ensure Quick Resolution of Property Disputes for Overseas Pakistanis

Special Courts Set Up for Overseas Pakistanis’ Property Disputes

To better address the property-related concerns of overseas Pakistanis, special courts are being established in Pakistan. Additionally, the Islamabad High Court has set up a dedicated bench to handle such cases efficiently.

According to Express News, the acting Chief Justice of the Islamabad High Court has ordered the establishment of these special courts. To ensure a smooth process, he has given session judges the authority to appoint judges for these courts.

To formalize this, the Registrar of the Islamabad High Court has sent a letter to the Secretary of Law and Justice. The letter outlines the process for appointing judges for the East and West Overseas Special Courts and emphasizes considering:

Pending cases to ensure a balanced workload.

Judges’ experience in handling property disputes.

This initiative is expected to provide overseas Pakistanis with faster, fairer, and more efficient resolutions to their property-related legal issues.

To address property disputes involving overseas Pakistanis, special courts will be set up in Islamabad under the Overseas Property Act 2024. These courts aim to ensure quicker resolution of legal matters related to properties owned by Pakistanis living abroad.

Key Developments

The Ministry of Law will issue notifications for the East and West Sessions Courts under the Overseas Property Act.

A special bench has been formed in the Islamabad High Court (IHC) to handle these cases.

Justice Khadim Hussain Soomro will oversee hearings and appeals related to overseas Pakistanis’ property disputes. The Deputy Registrar issued the notification after approval from the acting Chief Justice.
